BORDER LAW CREATES LEGAL BASIS FOR STRONG ALL-PEOPLE BORDER
At the 10th meeting session of the 14th National Assembly of Vietnam, lawmakers voted to ratify the Law on Vietnam Border with 456 ayes out of 462 voters, accounting for 94.61% of votes in favor.
The law consists of six chapters with 36 articles, providing for border guard duties, forces and coordination in executing border guard missions; international cooperation on border guard efforts and the Border Guard Force; and assurance and policies on border guards and responsibilities of organizations and individuals executing border guard duties.
The Law stipulates State policies on border guard work: Implementing the policy of independence, sovereignty, unity and territorial integrity; building a border of peace, friendship, cooperation and development and long-term stability with border-sharing countries; and expanding international cooperation, foreign defense, security, border defense and people's diplomacy.
The research and compilation of the draft Law on Vietnam Border was carried out in line with current regulations to ensure constitutionality, legality and consistency in the legal system; complied with power, form, order, and procedures for formulating and promulgating legal documents; ensured transparency, feasibility, accessibility and ease of application; aligned with gender equality and administrative procedure reform requirements; and free of obstruction to international treaties to which the Socialist Republic of Vietnam is a signatory.
Passed by the National Assembly, the Law on Vietnam Border will create a solid legal basis, provide favorable conditions for fulfilling lawmaking objectives, promote the synergy of the entire political system, build strong, stable and long-term all-people border, and meet task requirements of controlling and protecting national sovereignty and security in the new context.
Previously, on October 21, 2020, representatives of the National Assembly discussed online the draft Law on Vietnam Border, the Standing Committee of the National Assembly reported the outcome with explanations and revisions to the National Assembly and submitted the final draft to the NA for ratification.
The Law on Border is scheduled to take effect from January 1, 2022. The Ordinance on Border Guard 02/1997/PL-UBTVQH9 will cease to be effective on the effective date of this Law.
